1. Acceptance of Terms

By accessing, browsing, or placing an order on the Al Khaiyaat platform (including the website and mobile application, if applicable), you agree to be legally bound by these Terms and Conditions, along with our Privacy Policy, Returns Policy, and Delivery Information, collectively forming a binding agreement between you and Mohammad Asad Beg for Trading.

If you do not agree with any part of these terms, please discontinue use of the platform immediately.

2. Definitions

  • “We,” “Us,” “Our”: Mohammad Asad Beg for Trading, operating as Al Khaiyaat.
  • “You,” “Customer,” “User”: Any individual or entity accessing or purchasing from Al Khaiyaat.
  • “Platform”: The Al Khaiyaat website, mobile app, and related digital services.
  • “Products”: Goods offered for sale, including standard and custom-made items.
  • “Order”: A confirmed purchase made through the Platform after payment.

3. Eligibility to Use the Platform

You must:

  • Be at least 18 years of age.
  • Be a resident of the Kingdom of Saudi Arabia or able to legally purchase under Saudi law.
  • Provide accurate and complete personal information.
  • Use the Platform for lawful purposes only.

We reserve the right to suspend or terminate accounts that violate these terms.

4. Account Registration

To place orders, you may be required to create an account.

  • You are responsible for maintaining the confidentiality of your login credentials.
  • Notify us immediately of any unauthorized access or security breach.
  • We are not liable for losses due to your failure to safeguard account information.

5. Product Information and Availability

All product descriptions, images, prices, and availability are for informational purposes only and do not constitute a binding offer.

  • We make reasonable efforts to ensure accuracy, but we do not guarantee that descriptions, colors, or materials are error-free.
  • Pricing errors may be corrected at any time, even after order confirmation, if due to clear technical or clerical mistakes.

We reserve the right to:

  • Limit quantities.
  • Discontinue or update products without notice.
  • Refuse or cancel any order for any reason (e.g., stock unavailability, fraud suspicion).

6. Orders and Contract Formation

Your order constitutes an offer to purchase, not a binding contract.

A binding contract is formed only when:

  1. We accept your order, and
  2. Payment is successfully processed, and
  3. We send a shipping confirmation email.

We may decline any order without liability, including for reasons of fraud, stock issues, or non-compliance with these terms.

7. Pricing and Payment

  • Prices are listed in Saudi Riyals (SAR) and include VAT where applicable.
  • Payment methods include: Credit/Debit Cards (Mada, Visa, Mastercard), Apple Pay, STC Pay, Google Pay, and other digital wallets.
  • All payments are processed securely via PCI-DSS compliant third-party gateways (e.g., Paymob, HyperPay, or PayTabs). We do not store full card details.
  • You agree to pay all charges incurred under your account, including taxes and shipping.

8. Intellectual Property

All content on the Platform (logos, text, graphics, software, product designs, trademarks) is the exclusive property of Al Khaiyaat or its licensors.

You may not:

  • Copy, reproduce, or redistribute any content.
  • Use our trademarks without prior written permission.
  • Reverse-engineer or scrape the Platform.

Violations may result in legal action under Saudi Intellectual Property Law.

9. Custom-Made and Personalized Products

Products made to your specifications (e.g., tailored clothing, engraved items) are non-cancellable and non-refundable once production begins, unless defective or materially different from the agreed design.

  • You are responsible for providing accurate specifications.
  • We are not liable for errors caused by incorrect customer input.

This clause is permitted under Article 7(3) of the Consumer Protection Law.

10. Delivery and Risk of Loss

  • Delivery timelines are estimates and not guaranteed unless explicitly stated (e.g., express shipping).
  • We use third-party logistics providers (e.g., SMSA, DHL, Naqel). While we oversee delivery, delays due to force majeure (weather, traffic, etc.) are beyond our control.
  • Risk of loss transfers to you upon successful delivery to the address provided.

11. Returns, Refunds, and Warranty

Your statutory rights under the Saudi Consumer Protection Law are preserved.

  • Standard products may be returned within 7 days if unused and in original condition.
  • Custom-made items are excluded from return rights unless defective.
  • Defective products will be repaired, replaced, or refunded at our discretion.

12. Limitation of Liability

To the maximum extent permitted by Saudi law, Al Khaiyaat and Mohammad Asad Beg for Trading shall not be liable for:

  • Indirect, incidental, or consequential damages (e.g., lost profits, business interruption).
  • Delivery delays or failed deliveries due to third-party actions or customer error.
  • Misuse of products after delivery.
  • Any loss arising from reliance on Platform content.

Our total liability for any claim arising from these terms shall not exceed the amount paid by you for the relevant product.

13. Indemnification

You agree to indemnify and hold harmless Al Khaiyaat, its owners, employees, and partners from any claims, losses, or damages arising from:

  • Your misuse of the Platform.
  • False or fraudulent orders.
  • Breach of these Terms.
  • Unauthorized use of your account.

14. Modifications to Terms

We may update these Terms at any time. Changes will be:

  • Posted on the Platform with a new "Last Updated" date.
  • Communicated via email for material changes (where possible).

Your continued use of the Platform after updates constitutes acceptance.

15. Termination

We may suspend or terminate your access to the Platform at any time if you:

  • Violate these Terms.
  • Engage in fraudulent, abusive, or illegal activity.
  • Fail to make payments.

You may close your account at any time by contacting customer support.

16. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Kingdom of Saudi Arabia.

Any dispute shall first be resolved amicably through negotiation.

If unresolved, disputes may be referred to:

  • The Saudi Center for Commercial Arbitration (SCCA), or
  • The General Court in Riyadh.

Consumers may also file complaints with the Saudi Authority for Consumer Protection (SACP).

17. Force Majeure

We are not liable for failure or delay in performance due to events beyond reasonable control, including:

  • Natural disasters
  • War or civil unrest
  • Government actions
  • Pandemics
  • Internet or system outages

18. Severability

If any provision of these Terms is found invalid or unenforceable by a competent Saudi authority, the remaining provisions shall remain in full effect.

19. Entire Agreement

These Terms, together with our Privacy Policy, Returns Policy, and Delivery Information, constitute the entire agreement between you and Al Khaiyaat regarding your use of the Platform, superseding all prior agreements.
